We get it, the fine print isn’t as exciting as creating something bold and beautiful. These Terms of Service outline how Trusty Design Co. operates, the boundaries, expectations, and important details to agree on before the creative fun begins. Once that’s settled, the real magic can start!

These terms apply to all design projects with Trusty Design Co. (TDC). Please review them carefully. If you have any concerns, let us know before the project begins.

 

Payment

  • A 50% deposit is required before any work begins. An invoice will be emailed to you upon acceptance of your estimate, and payment is due within 30 days. Paying the deposit confirms your acceptance of these Terms of Service and forms a contract with Trusty Design Co. (TDC).
  • The remaining balance will be invoiced before the delivery of the final files. We will withhold delivery until full payment is received.
  • If communication from you stops for more than 30 days, TDC reserves the right to invoice for completed work up to that point.
  • Late payments (beyond 30 days) may result in additional fees, including collection costs.
  • Payment may be made by check (preferred) or card. Checks should be made payable to Trusty Design Company, 7106 Cooper LN, Fairview, TN 37062.

 

Typefaces & Font Licensing

  • Any fonts used in your project are subject to commercial licensing laws. Licenses grant usage rights only to the purchaser.
  • TDC will let you know which fonts are used and where to purchase them. It is your responsibility to obtain the appropriate licenses.
  • We cannot provide copies of fonts we have purchased. If you’d like to use them commercially (e.g., in print, web, or editable files), you must purchase your own license.
  • Fonts used in logos are typically converted to vector outlines, meaning no license is required unless you need editable files.

 

Restrictions

  • All sketches, concepts, drafts, and unused ideas remain the sole property of TDC and may not be used, copied, or adapted without written consent. Working files and drafts remain TDC’s property until the project is paid in full.
  • TDC may reuse or adapt unused concepts for future projects, provided they are modified to avoid direct conflict with your final design.
  • Unless covered by a confidentiality agreement (NDA), TDC may showcase your final design(s) in our portfolio, online galleries, award submissions, and publications.
  • You may modify the final logo at your discretion, but you do so at your own risk.

 

Ownership & Copyright

  • Once payment is complete, ownership of the final approved design transfers to you.
  • Any unused concepts remain the property of TDC.
  • If the final payment is not made, TDC retains full rights to all designs and may repurpose them.
  • Unauthorized use of unpaid work will result in immediate legal action.
  • TDC does not handle trademark, copyright, or legal name searches.
  • If you wish to register your logo as a trademark, you must seek independent legal advice.
  • You are responsible for ensuring your business or product name is legally available before starting the project.
  • TDC is not liable for legal issues that arise from your chosen name, and no refunds will be issued in such cases.
  • Changing your company/product name mid-project may result in additional costs and delays.

 

Cancellation & Suspension

  • If you cancel the project after concepts have been presented, deposits/payments are non-refundable.
  • If TDC is unable to complete the project (e.g., due to illness or unforeseen circumstances), a full or partial refund will be issued based on work completed.
  • TDC reserves the right to suspend a project if there is excessive micromanagement, repeated refusal to move forward, or non-payment.
  • Notice will be given, with an opportunity to resolve issues before suspension. Refunds will not be provided in such cases.

 

Force Majeure

  • TDC is not liable for delays or non-performance caused by events outside our control, including natural disasters, war, terrorism, government actions, accidents, supply issues, or other unforeseen circumstances.

 

Limitation of Liability

  • TDC is not responsible for any loss, damage, or legal issues arising from the use of our designs or services.
  • While we make every effort to provide original work, we cannot guarantee against all legal claims of similarity.
  • You are responsible for conducting your own due diligence regarding trademarks and originality.

 

Agreement

  • We may update or modify these Terms at any time, in accordance with applicable laws and standards, without prior notice. Any changes will take effect once the updated version is published on this Site. It’s your responsibility to review these Terms before using the Site and periodically thereafter to stay informed. If you do not agree to the current Terms, please discontinue use of the Site and our services. By continuing to browse or use this Site, you agree to any updated or amended Terms. If you have any questions or concerns about these Terms or any part of our Site, please contact us before completing a purchase.
  • By engaging Trusty Design Co. (TDC) and submitting payment, you acknowledge that you have read, understood, and agreed to these Terms of Service.
